Equality, Diversity and Inclusion on SiteEgalitate, diversitate și incluziune pe șantier

About one hour. Read the sections, work through nine site scenarios, then answer eight questions. Pass mark is seven out of eight. If you miss it, you get a second go the same day after re-reading what you missed. On passing, your certificate appears here and the record goes to the training office.

one crew, several passports

Our crews are mixed. Romanian, British, Polish, sometimes Portuguese or Lithuanian on the same job. Men and women. Twenty-year-olds and fifty-year-olds. People who pray and people who don't. We work for principal contractors whose site rules on this are strict, and who have thrown subcontractors off site for a single incident.

So this module is not an HR exercise. It is about three things that affect you directly. First, your right to be treated decently at work, and your colleagues' right to the same. Second, the fact that one bad joke or one message in the group chat can end a job for the whole crew, not just the person who sent it. Third, safety: a crew where people don't understand each other, or where someone is afraid to speak up, is a crew where things get missed at height.

By the end you'll be able to name the nine protected characteristics, tell the difference between banter and harassment, know what happens if a complaint is proven, and know exactly who to go to.

The law, in plain wordsLegea, pe înțelesul tuturor

Four pieces of UK law sit behind this module. You don't need the section numbers. You need the gist.

  • Equality Act 2010

The main one. It names nine characteristics that are protected, and it makes discrimination, harassment and victimisation because of them unlawful at work. It applies to how your employer treats you and to how you treat the people you work with.

  • Worker Protection Act 2023

Since October 2024, employers must take reasonable steps to prevent sexual harassment of their workers. That is why you are doing this module.

  • Employment Rights Act 2025

From 30 October 2026 the duty becomes "all reasonable steps", and employers are liable for harassment of their workers by third parties, meaning other trades, the principal contractor's staff and the public, unless they took all reasonable steps to prevent it. Reporting sexual harassment counts as a protected disclosure: nobody can lawfully be punished for reporting it.

  • Protection from Harassment Act 1997

Harassment can also be a criminal offence. Serious or repeated cases go to the police.

On top of the law sit the principal contractor's site standards, which are usually stricter and faster: investigation, suspension, and exclusion from every one of their sites.

Patru legi britanice stau în spatele acestui modul. Nu ai nevoie de numerele articolelor. Ai nevoie de esență.

  • Equality Act 2010

  • Protection from Harassment Act 1997

The nine protected characteristicsCele nouă caracteristici protejate

Nine. Learn the number and learn the list. Each one comes with the kind of thing that goes wrong on a site.

  • Age

"He's too old for the MEWP." "She's too young to supervise." Competence decides, not the date of birth.

  • Disability

Includes conditions you can't see: hearing loss, diabetes, dyslexia, mental health. Employers must make reasonable adjustments. Mocking someone's condition is harassment.

  • Gender reassignment

Someone who is changing, or has changed, their gender. Use the name and pronoun they ask for.

  • Marriage and civil partnership

Treating someone differently because they are married or in a civil partnership.

  • Pregnancy and maternity

Includes the months after birth. Comments about a pregnant colleague's ability to work, or decisions made about her without a risk assessment, are the usual failure.

  • Race

Colour, nationality, ethnic or national origin. On our sites this is the one that comes up most: nicknames, accents, "go back to", jokes about a country. It covers British colleagues too.

  • Religion or belief

Includes having no religion. Prayer breaks, religious dress, food, fasting during Ramadan. Also philosophical beliefs held seriously.

  • Sex

Being a man or a woman. Women on racking sites are few and the comments they get are the single most common sexual harassment complaint in construction.

  • Sexual orientation

Who someone is attracted to. "That's gay" as an insult counts, whoever it's said to.

Six behaviours, and how to tell them apartȘase comportamente și cum le deosebești

  • Direct discrimination

Treating someone worse because of a characteristic. The tell: a decision about work, pay, tasks or overtime made because of who someone is, not what they can do.

  • Indirect discrimination

A rule that looks neutral but hits one group harder, without a good reason. The tell: "it's the same rule for everyone" said about a rule that only some people can follow.

  • Harassment

Unwanted conduct related to a characteristic that violates someone's dignity or creates an intimidating, hostile, degrading, humiliating or offensive environment. The tell: it is about who they are, and it is unwanted. Whether you meant it as a joke does not matter. Whether they laughed does not matter. Banter, nicknames, gestures, images and group-chat messages all count.

  • Sexual harassment

Unwanted conduct of a sexual nature: comments, questions about someone's sex life, images, touching, "compliments" that aren't. The tell: you would not say or do it in front of your own family.

  • Victimisation

Treating someone badly because they complained, or helped someone else complain. The tell: a complaint last week, a worse shift, a cold shoulder or a missing name on the overtime list this week.

  • Bullying and intimidation

Not always linked to a characteristic, but always unacceptable under site standards and SSI policy. The tell: persistent, deliberate, and the person on the receiving end is afraid.

The one people get wrong most is harassment, because they think intent is what counts. It isn't. The test is the effect on the person and whether a reasonable person would see it that way.

What happens when it's provenCe se întâmplă când se dovedește

  1. Formal investigation

By SSI, by the principal contractor, or both. Statements are taken, messages and footage are collected. Where there may be a criminal offence, the police.

  2. Suspension from site

While the investigation runs. On most sites this is automatic and immediate, and it applies to the person accused, not to the person who reported.

  3. Indefinite exclusion

If proven: exclusion from every one of that contractor's workplaces, nationally, with no time limit. Plus SSI disciplinary action, up to dismissal. Some principal contractors share exclusion lists with each other.

Understand what that means for a racking installer. The principal contractors we work for own most of the big distribution-centre programmes in the country. Being excluded from one of them doesn't end a job. It ends a career.

Speaking up, and what inclusion looks like on a TuesdayRaportarea, și cum arată incluziunea într-o marți

SSI supervisor · SSI management · PC site teamSITE REPORT

Three routes, any of them is right. Your SSI supervisor. SSI management, by phone or in person; you don't need an appointment. The principal contractor's site team, who also have their own reporting system, usually a card, an app or a box in the welfare cabin. If something is urgent or criminal, the police.

You can report something that happened to you, something you saw happen to someone else, or something you heard about. You can report it in Romanian. You will be asked what happened, when, who was there and whether there are messages or footage. You won't be asked to prove it; that's the investigation's job.

Retaliation against anyone who reports is itself unlawful, and SSI treats it as seriously as the original complaint.

Inclusion in practice

  • Every briefing understood by every person. Translate, or ask for an interpreter. The register records the language used.
  • New starters eat with the crew, not on their own.
  • Respectful language, in both languages. What you'd say in Romanian about a British colleague counts the same as the reverse.
  • Shared welfare kept decent for the next crew, whoever they are.
  • If someone needs something to do the job safely, a radio, a prayer break, a seat for a medical reason, the answer is "let me sort it", not "no".

Eight things to rememberOpt lucruri de reținut

  1. Nine protected characteristics

Age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, sexual orientation.

  2. Harassment is about effect, not intent

"Only a joke" and "he laughed" are not defences.

  3. Group chats are the workplace

    And screenshots are evidence.

  4. Third parties count

Other trades, the client's staff, the public. Report it the same way.

  5. Victimisation is a separate offence

Nobody loses overtime, shifts or respect for reporting.

  6. Proven means excluded

From all of that contractor's sites, indefinitely.

  7. Three places to report

SSI supervisor, SSI management, the principal contractor's site team.

  8. Everyone understands the briefing

    Or it wasn't a briefing.

  3. Grupurile de chat sunt locul de muncă

Iar capturile de ecran sunt dovezi.

  4. Terții contează

Alte meserii, personalul clientului, publicul. Raportezi la fel.

  7. Trei locuri unde raportezi

Supervizorul SSI, conducerea SSI, echipa de șantier a antreprenorului principal.

  8. Toată lumea înțelege instructajul

    Altfel n-a fost instructaj.
